Statement Regarding Sexual Misconduct

Concerning Members of the Clergy and Individuals Acting Under Ecclesiastical Authority
I. Policy Overview
The Catholic Church of America maintains a zero-tolerance policy regarding sexual misconduct by clergy or any individual acting under its authority. Although daily interactions cannot always be observed, this statement reaffirms our unwavering opposition to inappropriate sexual behavior and outlines the procedures for reporting allegations.
II. Definition of Sexual Misconduct
- Unwelcome or unsolicited sexual remarks, gestures, or advances
- Inappropriate physical contact, such as groping, kissing, or touching
- Pursuing a sexual relationship after explicit rejection
- Any sexual conduct involving minors
- Acts of sexual perversion, predatory behavior, or pedophilia

IV. Investigation and Sanctions
- All allegations are taken seriously and must be reported immediately to the Presiding Bishop.
- The complainant and the accused will be notified within 48 hours.
- A Board of Inquiry (consisting of the Bishop and two clergy members) will convene within 72 hours.
- Investigations must conclude within 60 days, unless formally extended.
- The Board will determine disciplinary action and inform the complainant in writing.
V. Sacrament of Reconciliation Exception
Information disclosed during the Sacrament of Reconciliation is protected by the inviolable seal of confession and cannot be reported or investigated. This exception does not extend to spiritual counseling conducted outside the sacrament.
VI. Liability and Indemnification
The diocese is not liable for acts of misconduct committed outside the scope of ministry. All clergy agree to indemnify the Church against legal or disciplinary consequences resulting from misconduct.
VII. Post-Conviction Policy
- Clergy convicted of sexual misconduct are permanently barred from representing or serving the Church.
- No reinstatement is permitted following a conviction or substantiated allegation.
- Suspensions may only be lifted if allegations are determined to be unsubstantiated.
